1. Overview
This Personal Use License Agreement (“License”) grants you, the purchaser (“You” or “Licensee”), limited rights to use the digital artwork you have purchased (“Artwork”) for personal, non-commercial purposes only.
All rights not expressly granted remain the exclusive property of Phoebe Trites Art.
2. What You Are Allowed To Do
Under this License, you may:
• Download and store the Artwork on your personal devices
• Print the Artwork for personal display (e.g., home, dorm, private office)
• Use the Artwork as a personal wallpaper or background on your devices
3. What You Are NOT Allowed To Do
You may NOT:
• Use the Artwork for any commercial purpose, including business, marketing, branding, or promotional use
• Sell, license, sublicense, distribute, or share the Artwork or digital file in any way
• Post, upload, share, or display the Artwork on any online platform, including but not limited to social media, websites, forums, or file-sharing services
• Upload the Artwork to stock image websites, marketplaces, or digital asset platforms
• Use the Artwork in any product for sale (including prints, merchandise, or digital products)
• Modify, alter, or create derivative works of the Artwork for distribution or public use
• Claim the Artwork as your own or remove any associated attribution where present
4. Ownership & Copyright
The Artwork remains the intellectual property of Phoebe Trites Art and is protected under United States and international copyright laws.
Purchasing a digital download grants you a license to use the Artwork, not ownership of the copyright.
5. No Transfer of License
This License is non-transferable.
You may not give, sell, or transfer the Artwork file or your usage rights to any other person or entity.
6. Digital Goods Acknowledgement
By purchasing and downloading this digital Artwork, you acknowledge and agree that:
• The Artwork is a digital product delivered electronically
• Access to the Artwork may be made available immediately after purchase
• Due to the nature of digital goods, you may not be entitled to cancellation, return, or refund rights once the download has been accessed, except where required by applicable law
7. Refunds & Technical Issues
All sales are final once the Artwork has been downloaded or accessed.
If you experience a technical issue with your download, please contact us within 5 days of purchase, and we will make reasonable efforts to assist you.
8. Termination
This License is automatically terminated if you violate any of its terms.
Upon termination, you must delete all copies of the Artwork in your possession.
9. Governing Law
This License shall be governed by and interpreted in accordance with the laws of the State of Kansas, United States, without regard to its conflict of law principles.
